We agreed to the following trade

I was to send first (as I had fewer trades).

I sent the items listed above. She received the items I sent (as indicated by Delivery confirmation, and the fact that she sent me items - though she failed to indicate it in the trade system).
She sent the items listed above, but the Syberia she sent was not in the condition indicated ("excellent/mint").

Syberia was heavily contaminated with cigarette smoke and ash. The manual even had a scorched area on one of the pages. I tried to brush the ash off to clean the item and let it air for a few days, but to no avail. As several members of our household have Asthma this was not acceptable/usable condition, and clearly not the condition she represented it as.

I contacted her indicating the problem, and suggested a couple of alternative items that she could send me to replace the Syberia. (Anachronox or Vikings).

She thought that her son might have sent the wrong copy of Syberia, and said to
send back the damaged one, and she would either send a good copy of Syberia, or one of the other items I had suggested.

I sent the damaged Syberia to her - Media Mail with Delivery Confirmation
0302 0980 0000 9956 1781 on 7 Sept 2004.
The tracking information indicated that it arrived on 13th Sept. 2004.

I have not received the promised items. Nor have I received any further communication from Ms. Dauphinee in response to my inquiries.
I reported her activities to mail fraud - and they sent her a letter. But no results.
I delayed in posting this, as some others who had problems with her not sending items reported that they eventually did receive items from her.

To resolve this I would appreciate it if Ms. Dauphinee would send me
either: a copy of Syberia in reasonable condition, or Anachronox, or Vikings (adventure game), or, if she does not wish to go through with the trade, she can send back two of the games that I sent her (preferably Kings Quest and Full Throttle, but any pair of the CD based games would be okay), in the same condition as I sent them to her. If none of these are possible, I would also consider offer of other adventure games or cash sufficient to by Syberia, to resolve this.

We agreed to the following trade back around June 17 2004.

I was going to send: Wing Commander III: Heart of the Tiger (PC), Close Combat IV: The Battle of the Bulge (PC), Homeworld (PC), Journeyman Project 3: Legacy Of Time (PC), MechCommander 2 (PC), Warzone 2100 (PC)

She was to send:Stonekeep (PC), Anachronox (PC), The Guild: Europa 1400 (PC), Unreal II: The Awakening (PC), Divine Divinity (PC)

I sent my package on June 18th and was received by her a few days after. She finally mailed my package on July 8. I got my package on the 13th and everything was included except that Divine Divinity was not included. Instead she sent me Master of Orion 3. So it seemed like a simple mixup and that was fine.

So we were going to arrange a 2nd trade to exchange the mixed up games and perhaps trade a few other things. After long long periods of no contact I would get sporatic she would look at my list and what were we doing etc.. I am pretty sure there were other family members trading with this user name and such but it was like no one payed attention to the gametz site or messages. So pretty much no 2nd trade it looks like.

Anyway, long story is I didn't get what we agreed to and I have since no communication from her since September 2nd. I have tried to contact her many times via email and gametz with no responce from her. So no clue what I am supposed to do. I suppose I am better off than others in that I got most of what I was supposed to and even though I got the wrong game its better than nothing I guess.
I am willing to remove this BTR if Divine Divinty is sent to me as agreed. I would then return the wrong game she sent me. I hate doing this and frankly with all of these other BTRs I doubt anything will ever be done about it.

She contacted me on august 23rd saying that she was interested in some of the games (9) i was offering. I in return chose some (7) from her list. As per usual rules on the website, i was to send my games first; her account had positive feedback left from previous trades and i am a newbie. I sent the games on aug 24th using accelerated mail by Canada Post. There is a tracking number on this shipment and it attests that she received the games on sept. 2nd. She indicated through the website (not direct communication) that she supposedly sent the promised games on sept. 3rd. I did not receive the games yet, and attempt to communicate by email have been met with no response.

Many users have been apparently deceived by her and some suggest that she has intentionally frauded many people. I am not sure to which autority i should turn to, but i would like her to respond for what she did.

I have written a complaint to the U.S. Postal service, and i encourage others to do so too. Mail fraud is a felony and punishable by law.

I sent my package on Oct 6th and it is now October 23rd. She won't acknowledge that she recieved my games and won't return my emails. Now with all the bad trade reports about her from all the other gametz members she has had recent pending trades with, she clearly shows no interest in completing this trade or any other pending trade with any gametz member. She always insisted on me sending first even though I have 30 successful trades with excellent ratings and comments. I traded with her before in August for a few games and now I see that this was only to gain some trust from me so she could arrange this larger trade in late Sept which involves many more games and then totally rip me off. I just sent yet another email to her. If I don't here back from her within 24 hours, I'm reporting her to the Rochester NY police and USPS mail fraud division. I hope everyone else who she defrauded does too. I WANT MY GAMES BACK!

from the old trade we did in September, not the games we had agreed upon
in the October trade. You just re-sent me The Arrival (PC), Inherent Evil: The Haunted Hotel (PC), Revenant (PC), Temujin (PC) and War of the Worlds (PC). I don't want these games because I already have them. You are still not responding to my emails.

Send THESE games listed below that we agreed upon, and I'll send you back your duplicate games. Then I'll remove this BTR.

I keep receiving notices that I have a trade pended with a Bad Trader, and this trader is you.

I must admit: I can't help but agree with the other traders.

I used all the patience I had. I sent the 6 games I promised in a box, 4 months ago. I have yet to see the 5 games YOU promised, since they were still listed on your page 2 weeks ago (!!!), before you deleted your listings.

You told me your own package was returned to you since some items were "for US sale only" and blocked by the customs. I often buy from US online stores and receive these kind of games. And out of my 280+ trades, it simply never happened. Plus, note that we're not selling/buying, we're TRADING.

Then you told me you'd figure a way to get them to me somehow. I have yet to see this.

Then, one month later, after 2 unanswered e-mails, I re-contacted you, and then you did not even remember me, confusing me with someone else. Maureen, the "pending trade" section is supposed to be there for something...

I gave you a 2 week ultimatum, and I demanded dayly updates last week. I never heard from you ever since.

Many of the messages I sent were left unanswered. Too many. Why have you never posted any messages in our trade report, why have you not reported the reception of my part of the trade?

I consider myself an experienced, tolerant and patient GTZ user, and to tell the truth, I have never seen anything as bad as this, since there are so many traders in my position.

Like everyone else, I'm willing to remove this report should the games you owe me arrive here.

To think you were supposed to send first, and to think I finally sent first thinking you were trustworthy...


14/10/2004 NOTE:

I discovered something interesting tonight. You traded away my Lord of the Rings: The Return of the King even if I still don't have the games you owe me, speaking of wich.... you also traded 2 Elder's Scrolls Legend: Battlespire, while I still wait for the one you owe me... I hope you have the habit of keeping at least 3 original copies of the very same game, for you'll have a really hard time completing our trade...

We started this trade awhile back. It was for a friend, and they said they would do the trade if he agreed to send first since he wasnt on the site. So my friend sends and they receive and we wait for his package to come. After 3 weeks i sent an email and they explained that they had sent it out. After a month and a half i sent an email and they asked what the trade was for. I told them and she said that maybe her soon had done the trade. So she checked with him and he told her he sent it, so she told us to check the post office. My friend went and they said they had nothing for him. Its been two months, im going to need the game back or the games you promised me. Hate that it comes to this

I've tried, heaven knows I've tried to be patient, even faithful, but I have come to believe the stories I have been told are nothing but fantasy and some distorted attempt to buy time or some other excuse for not delivering the trade as promised. Below I will copy and paste the events that have transpired in one of two (thus far) failed trades with mdauphin. (Note to those interested: I have a successful trade with this person in the past, which although greatly delayed did in fact finally transpire after over a month and a half of waiting on my part. Depite this, perhaps foolishly, I negotiated yet more trades, which is how this whole sordid affair came into being.)
Copy and Paste begins:
Okay, I guess I have no other recourse. I have two outstanding trades with you that have been in process for over 2 months now. I can understand ( I guess ) having a package get messed up in the mail/damaged/etc. But it's now been over 2 weeks since I last heard from you about that even. I have been extremely patient, especially considering I sent you a collection worth many hundreds of dollars (even the extra Dreamweaver Ultradev for free), and I sent it immediately with delivery confirmation and insured the shipment for $250. You have shown no such consideration, in fact I have no way of knowing if a shipment has ever even been attempted. You agreed to ship immediately and with delivery confirmation and neither of these promises were kept, (nor were they in our last trade, but that is a moot point now.) I am now well past the point of patience and I will take action. If I do not receive all of the promised items from both trades within one week from tomorrow, September 18, I will file a BTR and I will also begin inquiries into initiating a mail fraud investigation. I have made numerous attempts over the last several months to resolve this trade in a friendly and cordial manner and I remain completely unsatisfied. I regret these actions will be necessary, but I do not see any other way to find satisfaction. I sincerely hope to receive a shipment within the next week as promised over 2 months ago.

I notice that you have had a BTR filed against you for a similar situation and that you have more than several trades initiated that have not been completed in over a month. I shipped my packages, (one of which was even insured), and they have been confirmed delievered. If I do not hear from you, I see no other recourse than to take a similar course of action, which I would rather avoid. As I stated earlier, I understand delays, but I have had zero feedback or communication from you aside from the brief message saying you mailed it and that was weeks ago. In my experience, packages don't take 3 or 4 weeks to deliver inside the states, and we're talking about two separate trades with the same delay?

Please let me know what you are doing to satisfy your end of the trade. Thanks.

Do you think there might be a way you could track the shipment to see if something has gone wrong? As you know, I shipped the items in our trades immediately, as agreed and you verified via email that you recieved them shortly thereafter as expected. I can understand a modest delay in shipping from time to time, but I have never experienced packages taking more than two weeks within the states before and I am beginning to get a little concerned and frustrated, especially since you had significant delays in our last trade as well. Any help or communication would be greatly appreciated. Thanks.

Oh yes, My wife has the manual for Adobe Photoshop boxed up somewhere, probably in storage with 90% of my other books. We'll be looking for it but I believe it has a PDF manual on the disk in the meantime. I can also email you a copy of the Photoshop Bible in PDF format if you would like sometime. (It's probably better than the manual anyway if truth be told). As we discussed via email, I did go ahead an include a copy of Dreamweaver Ultradev, which also has Homesite integrated into it, so I didn't put a Homesite disk in since it is redundant. (The Dreamweaver Ultradev is worth a pretty penny, around $400 new and they bought Allaire a couple of years ago who made Homesite -- good way to eliminate the competition I guess). I hope you enjoy everything and that it is helpful in your quest to become programming and design gurus! Wish your son the best for me and let's trade again sometime!

The Adobe products are basically what's inside the Adobe Creative Suite, the standard version of which costs $999. Even the upgrades I buy cost over $500. They have newer versions available now, (which I own - my business is web development and graphics work in addition to a small amount of programming from time to time so I upgrade almost every year), but the functionality changes very little with each upgrade, sometimes hardly at all. GoLive has changed substantially since the release I'm including, but the other products are almost the same. All in all, I believe it is a more than fair exchange. Let me know what you think.

There have been several times I have received email from mdauphin in response to my pleas for any form of communication to let me know what is happening. She makes a practice of not using the message tools within GameTZ, which I believe is to cover her tracks so there will not be a hard copy. I have kept each of these emails, due to my previous experience, but I will hold off on pasting them here to save a bit of space. If anyone is in need of these for reference, I will be happy to forward them to you if needed.

In short, I would love to get my end of the bargain. I shipped immediately, as agreed, which is what mdauphin agreed to as well. I not only used delievery confirmation but insured the packages as well. She did neither. Now I have nothing and several months have passed. This is way beyond reasonable. Take a look at how long her trades take on average and you will see I shouldn't be surprised, but I am beginning to seriously doubt I will ever see anything, despite her promises to the opposite. Even should I ever receive my shipments (there are two trades outstanding at present, each over 2 months now) I still believe mdauphin to be a very poor trader, both for honesty and timing. In my last trade I negotiated for a game called Vikings, which is a fairly new adventure game. What I received instead was some Vikings: the Strategy of Conquest game from the 1980's or early 1990's --- complete crap, which I ended up throwing in the trash bin. As an aside, I believe honesty comes into play in terms of shipping immediately when that is what you say you will do. Maureen Dauphin rarely does this. Take a look at her trades and you'll see what I mean. I heartily regret the good ratings I have last time, and you can be certain nothing of the kind will ever happen again from my point of view.

Oh, while I'm at it, one last note. Maureen also does not update her trade status as agreed. This is poor practice. For example, she received both of my shipments months ago, and yet has never indicated this by updating her trade status. This is deceipt, plain a simple, even if if seems a minor detail it portrays false information.

Sent him my copy of Heroes of Might and Magic III Complete over a month ago via UPS. According to UPS that package has been received and M Dauphin has stated in a previous private e-mail that Chrono Cross has sent out USPS and would try to track the package. A month later and still haven't received my goods, nor any word from M Dauphin.
